[PSC] MLC 증서와 DMLC Part I, II의 발행일자/장소 불일치 (PANAMA Flag)

PANAMA(파나마) 국적 선박 중국 Ningbo(닝보)항 접안 중 PSC 임검 실시되었습니다.

 

COVID-19 로 인해 Remote 로 시행되던 도중, 아래와 같은 지적이 발생했습니다.

 

지적사항

 

THE DATE AND PLACE OF ISSUE OF DMLC ON MARITIME LABOUR CERT. NOT CONSISTENT WITH THAT OF DMLC PART I OR PART II.

 

DMLC Part I/II와 해양노동증명서(MLC) 간 발행 일자 및 장소가 일치하지 않음.

대응

DMLC Part I 은 선박 인수 당시에 기국에서 승인/발행한다.

DMLC Part II는 선박 인수를 위한 Interim MLC 심사(Audit) 이전에 R.O(Registered Organization) 의 Review 를 받게된다.

 

이후, MLC Interim audit(최초심사) 이후, DMLC Part II 는 R.O 측 검사원에 의해 승인 및 서명된다.

 

즉, DMLC PART I 은 선박 인수 이전에 승인되고,

DMLC PART II 는 MLC FULL TERM 증서가 발행되는 최초 MLC 심사일자에 승인된다.

 

따라서, DMLC PART I 과 PART II 간 승인날짜 및 장소는 다를 수 밖에 없다.

7. Once the DMLC Part I is issued, the shipowner shall complete the Declaration of Maritime Labour Compliance Part II (DMLC-Part II), indicating the actions taken in order to ensure permanent compliance with the national requirements during the periods between surveys, as well as the measures proposed for guaranteeing continuous improvement of the aspects subject to survey.

DMLC Part I이 발행되면 선주는 해양 노동 준수 선언서 II(DMLC-Part II)를 작성하여 평가 기간 동안 국가 요건에 대한 영구적 준수를 보장하기 위해 취한 조치와 지속적인 개선을 보장하기 위해 제안된 조치를 명시해야 합니다.

 

8. That a recognized organization (RO) authorized by the Panama Maritime Authority, shall endorse the Declaration of Maritime Labour Compliance Part II (DMLC-Part II), once the full initial and renewal inspection has ended in accordance to the requirements of the MLC, 2006; and shall proceed to issue the Maritime Labour Certificate valid for five (5) years from the date of completion of the inspection on which this Certificate is based, in accordance to the MLC, 2006.

8. 파나마 해양 당국이 허가한 공인 기관(RO)이 MLC, 2006년 요건에 따라 전체 초기 및 갱신 검사가 종료된 경우, 해양 노동 규정 준수 선언서 II부(DMLC-Part II)를 승인하고, 유효한 해양 노동 증명서 발급을 진행해야 한다.5) MLC, 2006에 따라 본 인증서의 기반이 되는 검사를 완료한 날로부터 연도를 기준으로 한다.
